Terms of Use
These Terms of Use ("Terms") govern your access to and use of the codepixel.me website (the "Site"). By using the Site, you agree to these Terms.
These Terms do not cover services provided under a signed engagement (such as a Master Services Agreement or Statement of Work). Those services are governed by the engagement contract.
1. About us
The Site is operated by:
- Codepixel d.o.o. — registration number 5-0839589/005, PIB 03200116, VAT 30/31-20004-8, registered at Branka Miljkovića 32, 81000 Podgorica, Montenegro.
- Codepixel Canada — 1561844 B.C. Ltd. operating as Codepixel Canada, BC incorporation number BC1561844, CRA Business Number 760795633, registered office at 65-2838 Livingstone Ave, Abbotsford BC V2T 0J1, Canada (Canadian subsidiary of Codepixel d.o.o.).
References below to "Codepixel," "we," "us," or "our" mean these entities acting jointly with respect to the Site, with Codepixel d.o.o. as the primary operator and Codepixel Canada as the Canadian subsidiary.

2. Acceptance
By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
If you are using the Site on behalf of an organization, you confirm that you have authority to bind that organization, and "you" includes both you and the organization.
3. License to use the Site
We grant you a non-exclusive, non-transferable, revocable license to access and use the Site for:
- Learning about Codepixel's services.
- Submitting inquiries through our contact form or scheduler.
- Reading content (case studies, articles, documentation) for personal or internal business research.
You may not sublicense, sell, or commercialize this access.
4. Intellectual property
All content on the Site — text, code samples, designs, illustrations, logos, brand marks, and trademarks — is owned by Codepixel or our licensors, and protected by applicable IP laws.
You may not copy, redistribute, modify, or create derivative works from any part of the Site without our prior written consent, except for:
- Brief quotations for review or commentary (fair use / fair dealing).
- Sharing publicly visible URLs.
Third-party trademarks shown on the Site (for example, client logos) remain the property of their respective owners and are used with permission or under fair-use principles.
5. Acceptable use
You agree not to:
- Use the Site in a way that violates any applicable law.
- Attempt to gain unauthorized access to any part of the Site, related servers, or user accounts.
- Probe, scan, or test the vulnerability of any system without our documented permission (see our Security Statement for our responsible disclosure process).
- Scrape, crawl, or harvest content from the Site at a rate that materially impacts performance, or with intent to compete commercially with the Site.
- Submit automated form submissions (the Site uses Cloudflare Turnstile, honeypots, and rate limiting to block these).
- Impersonate another person or entity.
- Upload or transmit malware, viruses, or other malicious code.
- Interfere with another user's enjoyment of the Site.
Codepixel reserves the right to block or restrict access if these terms are breached.
6. User submissions
When you submit information through a form, schedule a meeting, or contact us by email, you confirm:
- The information is accurate to the best of your knowledge.
- You have the right to share it with us (e.g., you are not submitting someone else's confidential data without authorization).
- You grant Codepixel a limited right to use the information to respond to your inquiry and operate our business, as described in our Privacy Policy.
You retain all rights to your own content. We do not claim ownership of anything you submit.
7. Third-party services and links
The Site embeds the Pipedrive Scheduler iframe and may link to external sites (for example, our LinkedIn, Clutch profile, or third-party articles). We are not responsible for the content, accuracy, privacy practices, or availability of third-party services and sites.
Use of third-party services is at your own risk and subject to their own terms and policies.
The Site also exposes a small set of browser agent tools (via the emerging WebMCP standard) that let a compatible browser assistant open the discovery-call scheduler or navigate to site sections on your behalf. These tools only trigger functionality that already exists on the Site; they do not collect, store, or transmit personal data. Whether and how your browser or assistant uses them is governed by that product's own terms.
8. Disclaimer of warranties
The Site is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from a course of dealing or trade usage.
We do not warrant that:
- The Site will be uninterrupted, secure, or error-free.
- Defects will be corrected.
- Any content is current, accurate, or complete.
Nothing in this section limits any non-excludable statutory warranty required by applicable law (for example, consumer rights under EU law).
9. Limitation of liability
To the maximum extent permitted by law, Codepixel and its directors, officers, employees, and contractors shall not be liable for:
- Indirect, incidental, consequential, special, or punitive damages.
- Loss of revenue, profits, business, data, or goodwill.
Our aggregate liability for direct damages arising from your use of the Site is limited to €100 (or local equivalent).
These limitations do not apply to:
- Gross negligence or wilful misconduct.
- Death or personal injury caused by negligence.
- Any liability that cannot be limited under applicable law (e.g., mandatory EU consumer rights, statutory liability under Canadian consumer protection legislation).
10. Indemnification
You agree to indemnify, defend, and hold harmless Codepixel from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising from:
- Your breach of these Terms.
- Your violation of any law or third-party right.
- Content you submit through the Site, where unauthorized.
11. Suspension and termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we reasonably believe you have breached these Terms.
You may stop using the Site at any time.
Sections that by their nature should survive (IP, Disclaimer, Limitation of Liability, Indemnification, Governing Law) survive termination.
12. Governing law
These Terms are governed by:
- Montenegrin law, if you are based in Montenegro, the EU/EEA, the UK, Switzerland, or elsewhere outside Canada and the US.
- The laws of the Province of British Columbia and the applicable federal laws of Canada, if you are based in Canada (as the jurisdiction of Codepixel Canada) or the US.
This choice of law does not deprive you of mandatory consumer protections you may have under the law of your country of residence.
13. Dispute resolution
Before initiating any legal action, the parties will attempt to resolve any dispute in good faith by direct negotiation for at least 30 days after written notice from one party to the other.
If negotiation fails, the dispute will be resolved by the competent courts of:
- Podgorica, Montenegro (for users covered by Montenegrin law).
- The Province of British Columbia, Canada (for users covered by BC / Canadian federal law).
This does not deprive consumers of mandatory rights to bring proceedings in their country of residence under EU consumer law.
14. Severability
If any provision of these Terms is found unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
15. Entire agreement
These Terms, together with the Privacy Policy, Cookie Policy, AI Use Policy, Security Statement, Accessibility Statement, and Code of Conduct, constitute the entire agreement between you and Codepixel regarding the Site, and supersede any prior agreements.
For client services, the Master Services Agreement / Statement of Work governs. Where a conflict exists between those engagement documents and these Terms, the engagement documents prevail.
16. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date in the header reflects the most recent change. Material changes are highlighted at the top of the page for at least 30 days following the change.
Continued use of the Site after a change constitutes acceptance of the updated Terms.
